Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the RahPey application or website (collectively, the “Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. RahPey reserves the right to update these terms at any time; continued use after changes constitutes acceptance.

2. Description of Service

RahPey is a technology platform that connects passengers seeking transportation with independent drivers. RahPey does not itself provide transportation services; it facilitates connections between users and drivers through its digital platform. All rides are provided by independent drivers, not by RahPey.

3. User Accounts

To use the Service you must register an account using a valid mobile phone number and verify it with a one-time password (OTP). You are responsible for maintaining the confidentiality of your account and for all activities that occur under it. You must be at least 16 years of age to use RahPey as a passenger and at least 18 years of age to register as a driver. Providing false information during registration may result in immediate account termination.

4. Passenger Terms

Passengers may use the Service to request rides from available drivers. Fare estimates are provided before booking; final fares may vary based on actual route, traffic, and waiting time. Passengers must treat drivers respectfully and may not request drivers to violate any applicable laws. RahPey reserves the right to suspend accounts that generate repeated complaints from drivers.

5. Driver Terms

Drivers are independent contractors, not employees of RahPey. Drivers must hold a valid driving licence and maintain their vehicle in a roadworthy condition. Drivers must pass identity verification before being activated on the platform. RahPey may deactivate a driver account for low ratings, repeated complaints, or violation of these terms. Drivers are solely responsible for compliance with all applicable traffic laws and regulations.

6. Payments and Fees

Fares are calculated based on distance, time, and applicable surge pricing. Payment may be made by cash, in-app wallet, or other methods made available within the app. RahPey charges a service commission on each completed trip. All fares are displayed in Afghan Afghani (AFN). RahPey is not responsible for any bank or payment processing fees imposed by third parties.

7. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose.
• Harass, threaten, or harm any other user or driver.
• Create multiple accounts to circumvent a suspension or ban.
• Attempt to reverse-engineer, hack, or disrupt the platform.
• Provide false information about your identity or location.
• Use the Service to transport prohibited or illegal items.

8. Intellectual Property

All content, trademarks, logos, and software associated with RahPey are the exclusive property of RahPey or its licensors. You may not reproduce, distribute, or create derivative works from any RahPey materials without prior written permission.

9. Disclaimers

The Service is provided “as is” without warranties of any kind, express or implied. RahPey does not guarantee the availability, accuracy, or reliability of the Service at any given time. RahPey is not responsible for the conduct of drivers or passengers on the platform.

10. Limitation of Liability

To the maximum extent permitted by applicable law, RahPey shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. RahPey's total liability for any claim shall not exceed the amount paid by you to RahPey in the three months preceding the claim.

11. Termination

RahPey may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason at its sole discretion. You may delete your account at any time through the app settings. Upon termination, your right to use the Service ceases immediately.

12. Governing Law

These Terms are governed by the laws of the Islamic Republic of Afghanistan. Any dispute arising under these Terms shall be resolved through good-faith negotiation, and if unresolved, through the competent courts of Kabul, Afghanistan.
